Key Points of the Funding Agreement

The Terms for Funding Projects laid out below shall apply for all projects or institutions (Funding Recipients) funded by the Ernst von Siemens Music Foundation (the Foundation). By submitting the funding application you declare you agree to the Foundation’s terms and conditions formulated in accordance with the principle below. On the one hand, the funding agreement shall determine the funding terms and conditions below and, on the other, it can provide for further terms and conditions. The concluded funding agreement shall take precedence over these General Terms for Funding Projects.

1. Project-Specific Allocation of Funds

The allocated funds are project-specific. The Funding Recipient shall undertake to use this funding solely for the approved project / sub-project in accordance with the submitted project description of the overall project (incl. cost and financial plan).

2. Project Changes

In the event of any changes to the project / overall project the funding can only be upheld if the Foundation approves these changes in writing. No entitlement to Foundation approval shall exist. For this reason, the Foundation must be informed immediately about any planned changes (content-related changes, rescheduling, changes to parties involved, changes to the cost and financial plan etc.). In the event of unapproved changes the claim to a funding shall no longer apply and already paid sums must be returned.

3. Repayment Obligation and Right to Restitution

Should a project fail to be carried out the Foundation must be informed immediately of the reason for the cancellation in writing. The Funding Recipient shall undertake to return to the Foundation any already transferred funds unsolicited where a project fails to be carried out. The Foundation reserves the right to demand that the Funding Recipient return already paid funds and to withhold payment of any allocated funds in the event of breaches to the Agreement, in particular should the project not be carried out, there be no reports submitted, or should any changes to the project not be approved.

4. Disbursement of the Fundings

The Funding Recipient shall accept the funding will be paid in instalments. As a matter of principle, 80% of funding is authorized for payment 30 days after the meeting of the Ernst von Siemens Music Foundation Board held in the middle of the year. The remaining 20% shall be paid out once the project report has been checked. A written acknowledgement of receipt of payment must be submitted in accordance with the Foundation’s stipulations.

5. Final Report and Statement of Expenditure

Upon conclusion of the project the Funding Recipient shall, unsolicited and in accordance with Foundation stipulations, submit a written report on that project (incl. a tabulated statement of expenditure). With longer term projects among other things half-yearly written interim reports on project status, annual tabulated statements of expenditure as well as a final report must be submitted in accordance with Foundation stipulations.

6. Reference to the Funding

The Funding Recipient shall undertake to make reference to the Ernst von Siemens Music Foundation’s support in all project-related media (print media, electronic media etc.) in accordance with Foundation stipulations and to ensure that their cooperation partners make reference to the Foundation’s sponsorship in their project-related media. As a matter of principle, reference to the Foundation and positioning of the logo must be undertaken in such a way as to make it clear what project / part-project is being funded. Mention on a general sponsors or logos page shall not suffice here. All project-related media must be cleared by the Foundation in advance.

Mention in the event of general project support:

“With the friendly support of the [logo]”

Mention of fully supported commissions:

  • In project-related media: “Commissioned by (name of the institution of the Funding Recipient), funded by the [logo of the Foundation].”
  • In scores: “Commissioned by (name of the institution of the Funding Recipient), funded by the Ernst von Siemens Music Foundation.”

Mention in partially supported commissions:

  • In project-related media: “Commissioned by (name of the institution of the Funding Recipient), with the support of the [logo of the Foundation].”
  • In scores: “Commissioned by (name of the institution of the Funding Recipient), with the support of the Ernst von Siemens Music Foundation.”

In the event of partial or full support of commissions the Funding Recipient shall undertake to send back to the Foundation a document stipulating a reference be made to the support in the score signed by the composer along with the signed copy of the Agreement.

7. Foundation’s Publication Rights

The Funding Recipient agrees for the Foundation to publicize the project and the institution in the Foundation’s media (publications, Internet). The Funding Recipient shall make suitable visuals available to the Foundation to this end.

8. Taxes and Duties

All taxes and duties relating to a project shall be borne by the Funding Recipient.
